Blockchain Wakes: Balancing the Light and Dark Sides of Blockchain Through Global Regulation

Abstract

Since blockchain’s creation, it has inspired technological revolution, but regulation of the technology has been a hot topic. Blockchain generates endless amounts of good with its use, yet it also facilitates billions of dollars in illicit activities. This article argues that, to both allow its growth for good and to prevent bad actors from exploiting it, blockchain needs regulation across all world jurisdictions. This article compares blockchain use and regulation as it exists in the United States, Switzerland, China, Russia, and the European Union. It proposes several areas of needed reform that global jurisdictions should consider in regulating its use.

In addition to highlighting the importance of blockchain regulation and areas of needed reform, this article will hopefully trigger greater interest in blockchain technology and the law, a developing area of legal scholarship, and one of some importance.
