{"id":1038,"date":"2023-09-06T11:31:21","date_gmt":"2023-09-06T17:31:21","guid":{"rendered":"https:\/\/ctlj.colorado.edu\/?p=1038"},"modified":"2024-03-12T20:02:57","modified_gmt":"2024-03-13T02:02:57","slug":"1038","status":"publish","type":"post","link":"https:\/\/ctlj.colorado.edu\/?p=1038","title":{"rendered":"Reversing Privacy Risks: Strict Limitations on the Use of Communications Metadata and Telemetry Information"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-size: 14pt;\"><strong>Excerpt<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this paper, we examine private-sector collection and use of metadata and telemetry information\u00a0 and provide three main contributions:\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">First, we lay out the extent to which \u201cnon-content\u201d\u2014the hidden\u00a0 parts of Internet communications (aspects the user does not\u00a0 explicitly enter) and telemetry\u2014are highly revelatory of personal\u00a0 behavior. We show that, privacy policies notwithstanding, users\u00a0 rarely know that the metadata and telemetry information is being\u00a0 collected and almost never know the uses to which it is being put.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Second, we show that consumers, even if they knew the uses to\u00a0 which this type of personal information were being put, lack\u00a0 effective means to control the use of this type of data. The standard\u00a0 tool of notice-and-choice has well known problems, including the\u00a0 user\u2019s lack of information with which to make a choice; and then,\u00a0 even if the user had sufficient information, doing so is not\u00a0 practical.<\/span><span style=\"font-weight: 400;\">49 <\/span><span style=\"font-weight: 400;\">These are greatly exacerbated by the nature of the\u00a0 interchanges for communications metadata and telemetry\u00a0 information. Each new transmission\u2014each click on an internal link\u00a0 on a webpage, for example\u2014may carry different implications for a\u00a0 user in terms of privacy. The current regimen, notice-and-choice,\u00a0 presents a completely unworkable set of requests for a user, who\u00a0 could well be responding many times a minute regarding whether\u00a0 to allow the use of metadata beyond the purposes of content\u00a0 delivery and display. This is especially the case for telemetry, where\u00a0 the ability to understand both present and future use of the data\u00a0 provided from the sensors requires a deeper understanding of what\u00a0 information these devices can provide than anyone but a trained\u00a0 engineer would know.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Third, while there has been academic and industry research on\u00a0 telemetry\u2019s use, there has been little exploration of the policy and\u00a0 legal implications stemming from that use.
